1. Acceptance of Terms

These Terms of Service govern your use of Character AI and the services available through https://characterai.free. By accessing or using the site, you agree to these Terms and our Privacy Policy.

If you do not agree, do not use the service. If you use the service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

    2. Age Requirement

    You must be at least 13 years old to use the service, or older if the law where you live requires a higher minimum age to use online services on your own. If you are under the age of majority in your jurisdiction, you must have permission from a parent or legal guardian where required by law.

    By using the service, you represent that you meet the applicable age requirement, that you have legal capacity to agree to these Terms, and that your use of the service complies with applicable law and platform rules.

      3. Description of Service

      Character AI provides an AI Character platform where you can chat with a range of simulated personalities for entertainment, creativity, and companion-style conversation. Responses are generated by software and may be inaccurate, incomplete, repetitive, or inappropriate to the context.

      The service is not a human relationship, professional advisor, emergency service, or factual authority. You are responsible for how you interpret and use any output.

        4. User Accounts

        Some features may require an account. You agree to provide accurate information, keep it current, and use only accounts that belong to you or that you are authorized to use.

        We may suspend or restrict accounts that violate these Terms, create risk for the service, or are reasonably suspected of fraud, abuse, or unauthorized access.

          Account Creation

          When you create an account, you must provide complete and accurate registration information. You may not impersonate another person, use misleading identity details, or create accounts through unauthorized automated means.

            Account Security

            You are responsible for maintaining the confidentiality of your login credentials and for activity that occurs under your account unless caused by our failure to use reasonable security measures. Notify us promptly at legal@characterai.free if you believe your account has been compromised.

              5. Acceptable Use

              You agree to use the service lawfully and respectfully. You may not use Character AI to harm others, break the law, interfere with the site, or abuse the platform's systems or community features.

              • Do not upload, request, promote, or distribute illegal content, including CSAM or content that exploits minors.
              • Do not use the service for harassment, threats, stalking, hate speech, doxxing, or non-consensual sexual content.
              • Do not attempt to reverse engineer, disrupt, scrape, overload, or bypass security or access controls.
              • Do not use the service to spread malware, phishing, fraud, spam, or deceptive impersonation.
              • Do not submit content that infringes intellectual property, privacy, publicity, or other rights.

              6. Content and Intellectual Property

              The service contains software, design, branding, prompts, models, and other materials protected by intellectual property and other laws. Your use of the service does not transfer ownership of our rights or the rights of our licensors.

              Because AI output can be similar across users, we cannot guarantee that generated content will be unique or available for exclusive use by you.

                Our Content

                All rights, title, and interest in the site and service, excluding content you lawfully provide, remain with Character AI or its licensors. You may not copy, sell, sublicense, modify, or commercially exploit our content except as allowed by law or with written permission.

                  User-Generated Content

                  You retain any rights you have in content you submit, to the extent those rights exist. You grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, adapt, display, and use that content as needed to operate, secure, improve, and enforce the service.

                    7. Premium Features and Payments

                    Some features may require payment, a subscription, or the purchase of credits. If you choose a paid feature, you agree to the pricing, billing terms, and plan details presented at the time of purchase.

                    Payments may be processed by third-party providers. You authorize us and our payment processors to charge the selected payment method for applicable fees, taxes, and renewals if your plan renews automatically.

                      Subscription Plans

                      Paid plans may renew automatically on the schedule shown at checkout unless you cancel before the next billing date. You are responsible for reviewing plan details, including price, renewal timing, and included features, before completing a purchase.

                        Refunds

                        Except where required by law, fees are non-refundable once charged. If you believe you were billed in error, contact legal@characterai.free and include enough detail for us to review the issue.

                          8. Service Availability

                          We work to keep the service available, but we do not guarantee uninterrupted access or error-free operation. Features may change, be delayed, or become unavailable at any time, including for maintenance, security issues, provider outages, or product updates.

                          We may add, remove, or modify features without liability, to the extent allowed by law.

                            9. Limitation of Liability

                            To the fullest extent allowed by law, Character AI and its affiliates, officers, employees, contractors, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunities arising from or related to your use of the service.

                            To the fullest extent allowed by law, our total liability for claims arising out of or relating to the service will not exceed the greater of the amount you paid us in the 12 months before the claim arose or USD $50.

                              10. Indemnification

                              You agree to defend, indemnify, and hold harmless Character AI and its affiliates, officers, employees, contractors, and licensors from claims, liabilities, damages, judgments, losses, and expenses, including reasonable attorneys' fees, arising out of or related to your content, your misuse of the service, or your violation of these Terms or applicable law.

                              This obligation applies only to the extent permitted by law.

                                11. Termination

                                You may stop using the service at any time. We may suspend, limit, or terminate your access if we believe you violated these Terms, created risk or legal exposure, or interfered with the operation or safety of the service.

                                Termination does not affect rights or obligations that by their nature should survive, including payment obligations, intellectual property provisions, liability limits, indemnity, and dispute-related terms.

                                  12. Changes to Terms

                                  We may update these Terms from time to time. If we make material changes, we will post the revised Terms on the site and take any additional steps required by law.

                                  By continuing to use the service after updated Terms become effective, you agree to the revised Terms. If you do not agree, you must stop using the service.

                                    13. Governing Law

                                    These Terms are governed by the laws of the jurisdiction in which the service operator is established, without regard to conflict of laws rules, except where mandatory consumer protection laws in your place of residence apply and cannot be waived.

                                    If a court finds part of these Terms unenforceable, the remaining parts will remain in effect to the extent permitted by law.
